Montana State University in Bozeman is one of 45 universities currently under investigation for allegedly using race and sex based preferences in education programs and other activities. The investigation falls under the purview of the Office for Civil Rights (OCR). Investigations focusing on race based preferences fall under Title VI of the 1964 Civil Rights Act, and sex discrimination investigations fall under Title IX.

According to the Department of Education website, U.S. Secretary of Education Linda McMahon stated, “Students must be assessed according to merit and accomplishment, not prejudged by the color of their skin. We will not yield on this commitment.”

Institutions receiving federal funds received the “Dear Colleague” letter below. A section on page two of the letter states:

“Educational institutions have toxically indoctrinated students with the false premise that the United States is built upon “systemic and structural racism” and advanced discriminatory policies and practices. Proponents of these discriminatory practices have attempted to further justify them—particularly during the last four years—under the banner of “diversity, equity, and inclusion” (“DEI”), smuggling racial stereotypes and explicit race-consciousness into everyday training, programming, and discipline.

But under any banner, discrimination on the basis of race, color, or national origin is, has been, and will continue to be illegal.“

“Anyone who believes that a covered entity has violated these legal rules may file a complaint with the Department of Education’s Office of Civil Rights.
