Today the Montana Freedom Caucus filed an ethics complaint against Representative Zooey Zephyr of Missoula, seeking Zephyr's removal from the ballot in 2024. The complaint highlights Zephyr's actions in direct support of inciting a riot on the Montana Capitol building during the April 2023 legislative session. Zephyr made national news by remaining on the floor of the House and encouraging the riot despite having been ordered to vacate the floor by the Speaker of the House.

Recent cases have established the legal precedence necessary to ensure removal from the 2024 ballot is a legal remedy. One example is the removal of a County Commissioner in New Mexico.
